U.S. Federal Judge Dismisses xAI's Trade Secret Lawsuit Against OpenAI, Bars Refiling

In a recent ruling, U.S. Federal Judge Rita Lin dismissed xAI's trade secret litigation against OpenAI and prohibited xAI from refiling the case. The judge found that xAI failed to prove OpenAI solicited or knew that former xAI engineer Li Xuchen disclosed secrets related to the Grok chatbot during her interview. Judge Lin ruled that asking job candidates about their prior work experience during recruitment is standard industry practice, and characterizing such interviews as infringement would expose all employers to legal risk. The dispute centered on a PowerPoint presentation Li showed during her OpenAI interview; xAI claimed OpenAI sought Grok 4 model secrets due to gaps in its own reasoning and reinforcement learning capabilities. This marks Musk's second litigation loss against OpenAI in four weeks.
