German Court Rules Google Liable for False Statements in AI Overviews

According to a Munich court ruling flagged by The Decoder, Google has been held liable for false statements generated by its AI Overviews. The case involved two publishers who found that Google's AI Overviews incorrectly linked them to scams and dubious business practices. Despite receiving a cease-and-desist letter earlier this year, Google failed to correct the misleading output.

The court determined that Google's AI Overviews make "independent, new, and substantive statements" rather than merely presenting third-party links as traditional search engines do. As a result, Google must be held accountable for the false claims. The ruling, which requires Google to stop spreading these false statements in future AI Overviews, marks the first instance of a court holding an AI firm liable for AI-generated speech.
