Sen. Wyden Urges Senate to Preserve Section 604 Developer Protection in Clarity Act

According to a letter sent on July 8, Senator Ron Wyden (D-OR) urged Senate Majority Leader John Thune and Minority Leader Chuck Schumer to preserve Section 604 of the Clarity Act in any version brought to the Senate floor. The section, known as the Blockchain Regulatory Certainty Act (BRCA), protects non-custodial blockchain developers from being classified as money transmitters when they do not directly control users' digital assets. Wyden stated the provision provides legal clarity to software developers while allowing law enforcement to focus resources on actual wrongdoers, and said it codifies existing FinCEN guidance and recent case law.
