Senator Wyden Calls for Retaining BRCA in Clarity Act Ahead of Senate Vote

According to Fox Business, Senator Ron Wyden has called on Senate leadership to retain the Blockchain Regulatory Certainty Act (BRCA) in any version of the Clarity Act submitted for full Senate consideration. In a letter to Senators Thune and Schumer, Wyden stated that the provision would codify existing federal policy, clarifying that non-custodial software developers should not be treated as money transmitters solely for publishing software, while preserving the Department of Justice and FinCEN's ability to pursue illegal actors. The move comes as some enforcement agencies' positions on BRCA language and potential amendments remain uncertain.
