According to Reuters on July 22, Meta employees filed a lawsuit alleging the company used discriminatory AI tools to select workers for layoffs. A federal judge rejected a request to halt the terminations of 26 plaintiffs, citing evidentiary challenges: employees lacked access to internal data showing how Meta deployed AI in the decision process.

The plaintiffs claim they faced disadvantages due to disabilities, medical leave, or family care absences. However, arbitration agreements typically bar such cases from public court proceedings, limiting discovery options. Meta denied using AI to evaluate performance or select layoff candidates, stating all decisions were made by humans. A hearing is scheduled for August 24.
